Terms and Conditions
Prior to using the Seek Expert Job Portal / website (hereinafter referred to as the “Seek Expert Job Portal”), the User of the Seek Expert Job Portal (hereinafter referred to as the “User”) accepts the following terms and conditions, including any future amendments (hereinafter collectively referred to as the “Terms & Conditions”). Users agree to be bound by the terms and conditions listed below under the title “Terms & Conditions” by using the Seek Expert Job Portal.
Purpose of the Seek Expert Job Portal:
The Seek Expert Job Portal aims to bridge the employment gap between government offices, Autonomous bodies, Privet organizations, any other company whether it is a sole proprietorship, partnership and jointventure seeking fresh talent and students or aspiring candidates who have completed diploma, bachelor’s, or master’s degree programs with relevant backgrounds and experiences.
Terms & Conditions:
- The whole agreement between you and the company for the use of and access to the Services and/or other contents of the Seek Expert Job Portal is represented by these Terms and Conditions and the Privacy Policy Statement, which are hereby incorporated as if set forth fully herein.
- The Seek Expert Job Portal retains the right, at any time and without previous warning, to refuse service or registration to anybody. It is made clear that signing up on the portal does not ensure employment.
- Upon subscribing to Seek Expert Job Portal’s services, the user acknowledges that all personal data will be securely preserved, and aspirant candidates have the freedom to edit their personal information.
- Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.
- The Seek Expert Job Portal grants user’s permission to access and read content on the platform solely for personal use. All content, including text, images, logos, software, and other materials, as well as the compilation of content, is owned by the Seek Expert Job Portal. Unauthorized use, including selling, altering, reproducing, displaying, performing, distributing, or using the content for public or private purposes, constitutes a violation of the Seek Expert Job Portal’s copyright and other intellectual property rights.
- The user is solely responsible for maintaining the confidentiality of their account and passwords. They are also accountable for all activities occurring under their username, whether authorized or not. The user agrees to promptly notify the company of any unauthorized use of their account and password.
- The Seek Expert Job Portal reserves the right to modify, suspend, cancel, discontinue, or terminate its services, or reject any or all entries/blogs at its absolute discretion without prior notice and without assigning any reason to the user. This action will be taken without any liability to the Seek Expert Job Portal.
- The user is responsible for the use of the Seek Expert Job Portal, including any entries or posts made, and acknowledges that they will comply with all applicable laws, rules, and regulations, such as the Information Technology law. This includes adherence to laws regarding unfair competition, anti-discrimination, false advertising, and defamation. The user commits to using the Seek Expert Job Portal without violating third-party rights, including Intellectual Property Rights, Right of Privacy, and Right of Publicity. Additionally, the user agrees not to transmit, distribute, store, or destroy defamatory, obscene, threatening, abusive, or hateful material, including the content provided by the Seek Expert Job Portal. Violation of these terms, as well as the mentioned conditions, will result in the immediate termination of the user’s access to the Seek Expert Job Portal
- Users are strictly prohibited from engaging in activities that violate the security of the Seek Expert Job Portal, including, but not limited to: (a) Accessing data not intended for the user or logging into a server or account without proper authorization; (b) Attempting to probe, scan, or test the vulnerability of a system or network without authorization; (c) Attempting to interfere with the service for any user, host, or network, such as submitting viruses, overloading, “flooding,” “spamming,” “mailbombing,” or “crashing”; (d) Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting Violations of system or network security may result in civil or criminal liability. The company will investigate such violations and cooperate with law enforcement authorities in prosecuting users involved in such activities.
- The content of specific postings made by users is the responsibility of the user creating those posts. While the Seek Expert Job Portal reserves the right to filter out offensive, harmful, inaccurate, pornographic, or infringing content, including that which violates Intellectual Property Rights or rights of publicity or privacy, or is defamatory, libelous, threatening, or harassing, or contains viruses or other harmful programming routines, it does not assume responsibility for such content. The Seek Expert Job Portal acts as a platform to access user-posted content through its services. Users are urged to exercise caution, adhere to legal provisions, and take necessary precautions when uploading any content on the Seek Expert Job Portal.
- The Seek Expert Job Portal strictly prohibits user content that falls into the following categories:
- Explicitly or implicitly offensive content promoting racism, bigotry, hatred, or physical harm;
- Content that harasses, incites harassment, or advocates harassment of individuals or groups;
- Involvement in the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing or “spamming;
- Promotion or endorsement of false or misleading information, illegal activities, or conduct that is abusive, threatening, obscene, defamatory, libelous, or shows contempt for any judicial authority;
- Endorsement or promotion of the illegal or unauthorized use of copyrighted works, such as providing or making available pirated computer programs, links to them, or information to circumvent copy-protect devices;
- Content containing restricted or password-only access pages, hidden pages, or images;
- Display or linkage to obscene, indecent, or pornographic material;
- Provision of instructional information about illegal activities or actions prohibited by the terms, including making or buying illegal weapons, violating privacy, creating computer viruses, pirating media, or soliciting passwords or personal identifying information from other users.
- The contents, views and ideas expressed/posted are that of the respective Users and the Seek Expert Job Portal does not support/endorse any such views, ideas and expressions. Moreover, the Seek Expert Job Portal does not represent or guarantee the truthfulness, accuracy, or reliability of any such content posted by the Users, the ability of employers to offer job opportunities to candidates or the ability of the candidates to fill the job openings and makes no representations about any jobs, resumes or User Content on the web-site and the Users are cautioned to use common sense and proper judgment in this regard. The Seek Expert Job Portal is not involved in the actual transaction between the employers and candidates. Any reliance on the content posted by other Users using the Seek Expert Job Portal shall be entirely at the risk of the User. The User assumes all risks, including, but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under a false name and identity.
- The Seek Expert Job Portal reserves the right to access, read, preserve, and/or disclose the user’s personal information, including the content of postings/blogs, without providing prior notice if such action is deemed necessary:
- in order to comply with any court judgment/decree/order/
- by any legal/government authority;
- by applicable law;
- By professional/legal advisers, directors, employees, agents, or representatives of the Seek Expert Job Portal in connection with these terms and conditions or other related matters.
- for investigating potential violations of the terms herein or of applicable national & international laws;
- for investigating deliberate damage to the Services of the Seek Expert Job Portal or its legitimate operation;
- for responding to service support requests;
- for protecting the rights, property or safety of the Seek Expert Job Portal and/or its owner, employees and the general public at large.
- The Seek Expert Job Portal reserves the right to store and process user-provided personal information in Bangladesh or any other country where the Seek Expert Job Portal, its agents, representatives, or group companies maintain storage and processing facilities. The user, by utilizing the services, consents to such transfer of information outside Bangladesh without prior notice.
- The Seek Expert Job Portal is not liable for the deletion, failure to transmit, or store any user-posted content, personal information, or other communications through the provided services. Additionally, the Seek Expert Job Portal reserves the right to set limits on service usage and storage at its sole discretion, without assigning any reason and without prior notice.
- The Seek Expert Job Portal does not guarantee the error-free operation of the portal or its freedom from computer viruses or other harmful mechanisms. The Seek Expert Job Portal is not liable for any consequences, claims, damages, costs, etc., arising from technical errors, computer viruses, force majeure factors, or reasons beyond its control. To the fullest extent permitted by law, the Seek Expert Job Portal disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Seek Expert Job Portal makes no warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, and links on the website.
- The Seek Expert Job Portal shall not be responsible or liable in any manner whatsoever for the exercise or non-exercise of its rights herein.
- All the Seek Expert Job Portal’s trade names, trademarks, logos, domain names and all its content, are the exclusive property of the Seek Expert Job Portal and the User shall not use the same without the prior written permission of the Seek Expert Job Portal.
- The User agrees to allow the Seek Expert Job Portal to display the Users trade name, trademark, logo and office name as banner advertisements and for promotional messages of the Seek Expert Job Portal. The User reserves the right to withdraw this permission by writing to the Seek Expert Job Portal.
- The Seek Expert Job Portal reserves the right, at its sole discretion, to investigate and take legal action against individuals engaging in illegal or prohibited conduct or violating these Terms & Conditions. This includes removing user content from the website and/or terminating the offending user’s ability to access the site and/or use Seek Expert Job Portal services. The Seek Expert Job Portal may also take any other necessary or appropriate action with respect to user content or actions if it believes it may create liability or cause a loss of services from internet service providers or other suppliers, wholly or partially.
- The user agrees to indemnify the Seek Expert Job Portal, its owner, directors, partners, employees, and agents against any third-party claim, action, suit, or proceeding resulting from their use of the Seek Expert Job Portal’s services or arising from content submitted, posted, transmitted, or made available by the user. This indemnification applies to violations of these terms & conditions or any infringement of third-party rights
- The Seek Expert Job Portal will not be liable in any way whatsoever if a company, after conducting an initial round of interviews, either changes the requirement or puts the requirement on hold.
- The Seek Expert Job Portal disclaims any responsibility for agreements or financial arrangements between the user and a prospective employer. It is not liable for changes in the date of joining initiated by the employer. Additionally, if the proposed employer charges the user for training with the assurance of providing a job but fails to fulfill this commitment, the Seek Expert Job Portal holds no responsibility in such cases.
- The Seek Expert Job Portal reserves the right, at its sole discretion, to amend or revise these terms & conditions at any time without prior notice. The User agrees to be bound by such amendments or revisions. It is suggested that the User periodically reviews the updated version of these terms & conditions at smartjob.portal.gov.bd.
- These terms & conditions and the contract between the User and the Seek Expert Job Portal shall be interpreted under the framework of the Bangladesh law.
- In case of any civil dispute between the User and the Seek Expert Job Portal regarding the interpretation, breach, fulfillment, or non-fulfillment of these terms & conditions, the parties shall appoint a panel advocate dealing with consumer protection affairs for mediation, conciliation, or arbitration. If arbitration is required, a single arbitrator from the panel, mutually chosen by both parties, shall preside. The arbitrator must be a retired Judge or, alternatively, an advocate with a minimum of ten years of active practice in Civil Courts. The arbitration award will be final and binding, and the process will be guided by the provisions of the Arbitration Act 2001.
- In case of any private criminal proceedings being preferred either by the User or the Seek Expert Job Portal against the other, the Courts in Mumbai shall have the exclusive jurisdiction over the same.
Stipulations for employers (This section is part and parcel of Section I- Terms & Conditions):
- There is no charge for registration of prospective employers. The login is free for lifetime. The prospective employers can register, post jobs and search suitable candidates. The prospective employers even can announce walk-in interviews through the Seek Expert Job Portal;
- Initially, it’s free. However, the Seek Expert Job Portal has the liberty to charge. Each prospective employer gets 12 free job postings and ten thousand mass mailing facilities. If more postings or mass mailings are needed, the Seek Expert Job Portal will provide them at the applicable price to the employer;
- The prospective employer shall only post their requirement for filling up vacancies for jobs;
- No firm or company shall post fake advertisements in the garb of being an employer;
- The prospective employer shall not charge the candidates unless the guidelines of the employing firm clearly state so;
- The prospective employer shall take care to be fully transparent with candidates before offering employment and shall not conceal any information from the candidate so that a candidate is enabled to take an informed decision about taking up the employment;
- Once the prospective employer has remitted the amount to the Seek Expert Job Portal for advertisement and additional services, the same shall not be refundable under any circumstances;
- The Seek Expert Job Portal will be at liberty to use the name of the registered employers, their logo for marketing and branding purposes;
Refund & Cancellation Policy (This section is part and parcel of Section I- Terms & Conditions):
- For online registration and any other services obtained from the Seek Expert Job Portal, there will be no initial charge. However, under no circumstances, if the Seek Expert Job Portal applies any fee later, it will not be liable to refund any amount once paid by the User;
- In case of duplicate / multiple payments for a single product, the Users are advised to bring the same to the concerned authority. After notification is received from the User, the Seek Expert Job Portal shall be not liable for the extra amount. The User is advised to notify the concerned authority within 7 days of the transaction, after which the concerned authority disclaims its liability to refund the same.
- Seek Expert Job Portal will not be held responsible if someone receives money on behalf of the Seek Expert Job Portal.
Interpretation (This section is part and parcel of Section I- Terms & Conditions):
Wherever, the male gender is referred to as “his”, “him” and “he”, it shall be construed to include the female gender.
Wherever, the context requires, the term “Seek Expert Job Portal” shall mean and include the owner / partner / director of the Seek Expert Job Portal
